Workers' compensation is designed to protect
workers and their dependents against the
hardships from injury or death arising out of
the work environment. There are many ways
employees can be injured at work, including
vehicle accidents, lifting, cutting or crushing
trauma, and slips and falls. Occupational
illnesses are usually the result of long-term
exposure or repetitive motion injuries (carpal
tunnel), toxic chemicals, heart attacks and
exposure to toxic materials. Workers'
Compensation laws provide money and medical
benefits to an employee who has an injury as a
result of an accident, injury or occupational
disease on the job.
The following are general guidelines under
which you are eligible to receive Workers'
Compensation benefits in Kansas through June
2005:
- Maximum - $449
- Minimum - $25
- Minimum Survivors
Benefit...................$299
- Mileage Reimbursement..........37 cents
per mile (As an employee injured on the job,
you are generally entitled to mileage
reimbursement for trips to see a physician
for distances in excess of five miles for
the round trip. If you must hire
transportation, this can also be
reimbursed.)
Kansas also has several categories of
disability compensation benefits including;
Temporary Total Disability; Permanent Total
Disability; Permanent Partial Scheduled
Disability; Permanent Partial General
Disability; and Survivors' Benefits which are
paid to an employee's surviving spouse and
dependent children if death occurs as a result
of injury. Burial expenses up to $5,000 are also
covered.
It is not always easy to obtain benefits, and
injured employees may be denied benefits if they
fail to prove that their injury was job related.
The national Workers
Compensation Website recommends hiring legal
representation to help guide you through the
complex claims process. The website identifies
several circumstances in which "…hiring a
lawyer is critical…", particularly in
situations where an employer denies that you
were injured on the job, a carrier has denied
benefits, you cannot get medical treatment, you
are not getting paid, or the adjustor promises
benefits or care that never arrives and other
circumstances.
Only experienced counsel can advise you of
the appropriate course of action to increase the
probability of winning your claim and adequately
represent you to insurance companies. An
attorney at The Law Office of Paul Hogan, LLC
can help prepare a comprehensive, compelling
case for your right to receive benefits. For
